Disclosures

The most common issue we deal with is the Seller not disclosing information affecting the property value.  Usually this occurs from Sellers not disclosing unpermitted property additions, but it covers anything within the Sellers’ knowledge that the Buyer could not reasonably know. 

The law goes both ways and protects Sellers from Buyers who attempt to use it as a tool to force the Seller to pay for unnecessary remodeling.


Transaction Documents

We assist in helping Seller’s prepare the Residential Purchase Agreements and other necessary forms required for closing escrow when selling a home directly to a buyer without an agent or broker.  In these types of situations, we charge a flat rate of 1.0%.

We review mortgage documents to help ease any concerns from the lender. 


Landlord - Tenant

California provides strong protections for tenants.  We dealt with landlords illegally withholding security deposits as well as helping tenants legally break their lease when it is no longer habitable, which can stem by anything ranging from unchecked mold growth to wildfire damage.  If the tenant's property is damaged from no fault of their own, we can help you get paid the replacement costs of your items.

A new rent control law effective January 1, 2020 makes it harder for many landlords to raise your rent past 5% (plus the rate of inflation) or to evict you without “just cause,” even if you are in a one-year lease that expires. 

While California provides strong tenant protections, many tenants push their luck and attempt to curtail their landlord's rights.  When a tenant has gone too far, we assist landlords in legally evicting them.  Each city requires a different approach as there may be localized rent control ordinances that must be followed in conjunction with the new 2020 rent control law.
